ShokuPlan provides personalized meal planning services, recipe databases, shopping list generation, and nutritional guidance tailored to individuals living in Japan. Our services include both free and premium subscription tiers.

Free Services: Limited access to our recipe database, basic meal planning tools, and general nutritional information is available to all registered users without charge.

Premium Subscriptions: Full access to our complete meal plan library, personalized recommendations, dietary customization, shopping list integration, and registered dietitian consultations requires a paid subscription.

Service Availability: While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

The information provided through our services is for educational and informational purposes only. It is not intended as medical advice and should not replace consultation with qualified healthcare professionals.

Account Registration and Security

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for each renewal period.

Price Changes: We reserve the right to modify subscription pricing at any time. Price changes will not affect your current billing period but will apply upon renewal. We will provide at least 30 days' notice before any price increase takes effect.

Payment Methods: We accept various payment methods as indicated during the checkout process. You represent and warrant that you have the legal right to use any payment method you provide to us.

Failed Payments: If we cannot process your payment, we will attempt to notify you and may suspend your access to premium features until payment is received.

Refund Policy: Refunds are generally not provided for partial subscription periods. However, we may offer refunds on a case-by-case basis at our sole discretion within 7 days of the initial purchase.

User-Generated Content and Conduct

Health Outcomes: We are not liable for any health outcomes, weight changes, allergic reactions, or other physical effects that may result from following our meal plans or recipes.

Maximum Liability: In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law, but in no event will exceed the amount you paid to us in the twelve months prior to the event giving rise to liability.

Indemnification and Hold Harmless

You agree to defend, indemnify, and hold harmless ShokuPlan and our subsidiaries, affiliates, officers, directors, employees, agents, and partners from and against any loss, damage, liability, claim, or demand arising out of or related to:

Your use of and access to the services; your violation of these Terms of Service; your violation of any third-party right, including any intellectual property, privacy, or property right; any claim that your user-generated content caused damage to a third party; or any harmful, false, misleading, or inaccurate information you provide.

This indemnification obligation will survive termination of these Terms of Service and your use of the services.

Dispute Resolution and Governing Law

These Terms of Service and your use of the services are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

Informal Resolution: Before initiating formal legal proceedings, you agree to first contact us to attempt to resolve any dispute informally. We will attempt to resolve disputes in good faith within 30 days of receiving notice.

Jurisdiction: Any legal action arising from or relating to these Terms of Service or the services must be brought exclusively in the courts located in Fukuoka, Japan, and you consent to personal jurisdiction in these courts.

Class Action Waiver: To the extent permitted by law, all claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Severability and Waiver

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms of Service and will not affect the validity and enforceability of any remaining provisions.

No waiver by ShokuPlan of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition, and any failure to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

Modifications to Terms and Services

We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. Material changes will be notified to users at least 30 days before they take effect through our website, email, or other appropriate means.

Your continued use of the services after any changes to these Terms of Service constitutes acceptance of those changes. If you do not agree to the modified terms, you must stop using our services.

We also reserve the right to modify, suspend, or discontinue any aspect of our services at any time without liability, though we will provide reasonable notice for changes affecting paid subscriptions.
